Terms of Service

1. Acceptance of Terms

By accessing or using Re-create.ai (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. These Terms form a legally binding contract between you and the operator of Re-create.ai (the "Operator"). The Operator's full contact details are in the Impressum.

If you do not agree with these Terms, do not use the Service. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of Service

Re-create.ai is an AI-powered content creation and planning platform designed for YouTube content creators. The Service enables you to:

  • Save and analyze YouTube videos by URL
  • Automatically fetch and process video metadata and transcripts
  • Generate AI-powered content assets (titles, hooks, descriptions, scripts, ICP analyses, mind maps)
  • Generate AI thumbnail images based on your brand and content
  • Interact with an AI content assistant trained on your knowledge base
  • Plan and organize your content publishing calendar
  • Share diagrams and visual content via public links
  • Participate in a creator community (posts, comments, leaderboard)
  • Connect a Telegram account for notifications
  • Use your own OpenAI API key (BYOK — Bring Your Own Key)

We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable prior notice.

3. Account Registration and Eligibility

To use the Service, you must:

  • Be at least 16 years of age
  • Have a valid Google account for OAuth sign-in
  • Provide accurate and truthful registration information
  • Not have had an account previously terminated for violations

You are responsible for maintaining the security of your account credentials. You may only create one account per person. Notify us immediately at getrecreateai@gmail.com if you suspect unauthorized access to your account.

4. Subscription Plans and Credits

4.1 Available Plans

We offer Free, Starter, Pro, and MAX subscription plans. Paid plans are billed monthly or annually. Current pricing is displayed on our Pricing page.

4.2 Credit System

Most AI generation features consume credits from your account balance. Credits are allocated based on your plan tier and reset at the beginning of each billing cycle. Key rules:

  • Credits do not carry over to the next billing cycle — unused credits are forfeited at cycle end
  • Credits are consumed when AI generation requests are successfully submitted, regardless of whether you use the result
  • Credits are non-refundable once consumed
  • We reserve the right to adjust credit pricing with 30 days advance notice

4.3 Credit Top-Ups

You may purchase additional one-time credit top-ups at any time. Top-up credits are added to your balance immediately and do not expire as long as your account remains active. Top-up credits are consumed before plan credits.

4.4 Free Plan

The Free plan provides a limited credit allocation at no charge with no credit card required. We reserve the right to modify or discontinue the Free plan with 30 days advance notice. Free plan credits reset monthly.

5. Payment Terms

5.1 Processing & Authorization

All payments are processed by Stripe, Inc. By subscribing to a paid plan or purchasing top-up credits, you authorize Stripe to charge your selected payment method for the amount due. Stripe's terms apply to payment processing.

5.2 Subscription Renewals

Paid subscriptions renew automatically at the start of each billing period (monthly or annual). You will receive an email reminder before annual renewals. To cancel automatic renewal, use the Customer Portal accessible from your account settings.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current paid billing period — you retain full access until then. No refund is issued for the remaining period unless required by law (see Section 6).

5.4 Price Changes

We may change subscription prices. We will provide at least 30 days advance notice by email before any price change affects your active subscription. Continued use after the effective date constitutes acceptance.

5.5 Failed Payments

If a payment fails, we will retry the charge according to Stripe's retry schedule. If payment cannot be collected after reasonable retries, your access may be downgraded to the Free plan and your subscription cancelled.

5.6 Taxes

Prices shown may be exclusive of applicable taxes (e.g. VAT for EU consumers). The applicable tax rate will be calculated and displayed at checkout based on your location. You are responsible for any taxes imposed on your use of the Service.

6. Right of Withdrawal (Widerrufsrecht — EU Consumers)

This section applies to consumers (Verbraucher) in the European Union.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period starts on the day the contract is concluded (the day of subscription).

To exercise your right of withdrawal, contact us at getrecreateai@gmail.com or use the standard withdrawal form at re-create.ai/widerrufsbelehrung.

6.1 Exception — Immediate Service Commencement

At the time of purchase, you are asked to explicitly confirm that you request immediate commencement of the Service and acknowledge that you thereby waive your right of withdrawal once the Service has begun.

For subscription services that continue beyond the 14-day period, you retain the right of withdrawal for the portion of the service not yet performed.

6.2 New: Withdrawal Button (from June 19, 2026)

In compliance with the upcoming EU directive (effective June 19, 2026), we will provide a prominently labeled electronic withdrawal button ("Vertrag widerrufen") accessible from your account settings, allowing you to initiate withdrawal without needing to contact us by email.

7. Refund Policy

  • If a technical issue on our side prevents you from using a paid feature and we cannot resolve it within 72 hours, you are entitled to a proportional refund for the affected period.
  • Annual subscriptions: a full refund is available within 14 days of the original purchase date, provided you have not used more than 10% of the annual credit allocation.
  • Credits already consumed are non-refundable.
  • Top-up credits are non-refundable once purchased, unless required by applicable law.
  • To request a refund, contact getrecreateai@gmail.com with your account email and reason.

8. Acceptable Use Policy

You agree NOT to use the Service to:

  • Generate illegal, harmful, harassing, defamatory, hateful, or fraudulent content
  • Create AI-generated content that impersonates real people in a misleading way (deepfakes used for deception)
  • Violate the intellectual property rights of third parties
  • Circumvent credit limits, usage restrictions, or access controls
  • Share your account credentials with others or allow multiple users to access a single account
  • Attempt to reverse-engineer, copy, or extract our AI prompts, system architecture, or proprietary algorithms
  • Use automated scripts or bots to interact with the Service outside our provided API
  • Scrape, copy, or redistribute our platform, content, or user data
  • Generate spam, bulk unsolicited content, or automated low-quality content at scale for SEO manipulation
  • Violate YouTube's Terms of Service (youtube.com/t/terms) when processing YouTube content
  • Use the Service for any purpose that violates applicable law in Germany, the EU, or your country of residence

Violations may result in immediate account suspension or termination without refund.

9. YouTube Content and Third-Party Content

When you save YouTube video URLs, the Service fetches publicly available metadata and transcripts via YouTube's systems. You acknowledge that:

  • You should only process YouTube content for legitimate content creation purposes (inspiration, analysis, repurposing your own content)
  • You are responsible for ensuring your use of YouTube data complies with YouTube's Terms of Service and copyright law
  • Re-create.ai is not affiliated with, endorsed by, or in any way officially connected to YouTube or Google LLC
  • AI-generated content inspired by YouTube videos must be original and not constitute plagiarism or copyright infringement
  • Transcript accuracy may vary — we do not guarantee the accuracy of automatically fetched transcripts
  • We do not store any YouTube video files — only publicly available metadata and transcript text

"YouTube" is a trademark of Google LLC.

10. Intellectual Property

10.1 Your Content

You retain all intellectual property rights to content you create using the Service, including AI-generated outputs you have edited and refined. You grant us a limited, non-exclusive, worldwide, royalty-free license to process, store, and display your content solely to provide and improve the Service.

10.2 AI-Generated Content

Content generated by AI features is provided as a creative starting point. We do not claim copyright ownership over AI-generated outputs. However:

  • AI-generated content is not guaranteed to be unique — similar content may be generated for other users using similar inputs
  • The copyrightability of purely AI-generated content (without human creative input) may vary by jurisdiction
  • You are responsible for reviewing AI outputs for accuracy, appropriateness, and originality before publishing

10.3 Our Platform

Re-create.ai, its software, design, branding, trademarks, and all platform-proprietary content (prompts, features, UI) are the intellectual property of the Operator. You may not reproduce, distribute, modify, or create derivative works from our platform without prior written permission.

11. AI-Generated Content Disclaimer

By using AI features, you acknowledge and agree that:

  • AI outputs may be inaccurate, incomplete, factually incorrect, or unsuitable for your intended purpose
  • You are solely responsible for reviewing, editing, and verifying all AI-generated content before publishing it anywhere
  • Re-create.ai does not guarantee that AI outputs comply with any platform guidelines (YouTube, Instagram, TikTok, etc.)
  • AI systems may occasionally produce unexpected, repetitive, or inappropriate outputs — you should apply editorial judgment
  • Re-create.ai is not liable for any consequences arising from the publication of unreviewed AI-generated content
  • AI-generated thumbnails are for creative assistance — ensure generated images comply with the platform policies of wherever you publish them

12. EU AI Act Compliance Notice

In accordance with Article 50 of the EU AI Act (enforceable from August 2, 2026), we inform you that Re-create.ai uses AI systems for content generation. Our AI features are creative productivity tools — not high-risk AI systems as defined in Annex III of the EU AI Act. You remain in full control of all content you create and publish.

13. Community Features

  • Community posts and profiles are public and visible to all users and visitors
  • You are responsible for all content you post in the community
  • You may not post illegal content, harassment, spam, or content that violates others' intellectual property rights
  • We reserve the right to remove community content and suspend accounts that violate these guidelines, without prior notice in serious cases
  • By posting in the community, you grant us a worldwide, non-exclusive license to display your community content within the Service

14. Limitation of Liability

To the maximum extent permitted by applicable law (including mandatory German consumer protection law):

  • We provide the Service 'as is' without warranties of merchantability, fitness for a particular purpose, or uninterrupted availability
  • We are not liable for indirect, incidental, special, or consequential damages (including lost profits, lost data, or business interruption) arising from your use of the Service
  • Our total cumulative liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim
  • Nothing in these Terms limits liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under German law (including BGB § 309 Nr. 7)

15. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance (with advance notice where possible) and are not liable for interruptions caused by factors outside our reasonable control, including: third-party service outages (Supabase, Stripe, OpenAI, Vercel), internet infrastructure failures, natural disasters, or government actions.

16. Termination

16.1 By You

You may delete your account at any time from Profile → Settings. Upon deletion, your content data will be purged within 30 days (subject to retention obligations in Section 7).

16.2 By Us

We may suspend or terminate your account if you materially violate these Terms. For serious violations (illegal activity, fraud), we may terminate immediately without notice. For lesser violations, we will typically provide a warning and an opportunity to remedy the issue. Upon termination of a paid subscription by us for violation, no refund will be issued.

17. Changes to These Terms

We may update these Terms. For material changes, we will provide at least 30 days advance notice by email and/or in-app notification. The updated Terms will be effective on the stated date. Continued use of the Service after the effective date constitutes acceptance of the new Terms. If you do not agree, you must stop using the Service and may cancel your subscription.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. If you are a consumer in the EU, the mandatory consumer protection laws of your country of residence also apply.

We are not obligated to participate in formal dispute resolution proceedings before a consumer arbitration board, but we are committed to resolving disputes amicably. Please contact us first at getrecreateai@gmail.com.
